Terms of Use

Please read these Terms of Use ("Terms") carefully before using the Filmari iOS application ("the App") developed by Jakub Mičuch ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms constitute an agreement between you and Jakub Mičuch only — not with Apple Inc. Apple is not responsible for the App or its content.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on Apple-branded devices you own or control, in accordance with these Terms and Apple's Media Services Terms and Conditions.

You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit the App or your access to it. You may not copy, modify, distribute, or create derivative works based on the App or any part of it.

2. Prohibited Use

You agree not to:

  • use the App for any unlawful purpose;
  • attempt to decompile, reverse engineer, or disassemble the App;
  • attempt to gain unauthorized access to any part of the App;
  • use the App in any way that could damage, disable, or impair it.

3. Data and Storage

All data you create within the App — including projects, shot lists, inventory lists, presets, client information, and billing details — is stored locally on your device. If you have iCloud enabled, data may be synced across your own Apple devices via Apple's CloudKit. We have no access to your data at any time.

You are solely responsible for maintaining backups of your data. We are not liable for any loss of data due to device failure, software errors, accidental deletion, or any other cause. The App provides an export feature (.flmr files) to help you back up your data — we strongly encourage you to use it.

4. Intellectual Property

The App, including its design, code, graphics, calculators, tools, and all other content, is the exclusive property of Jakub Mičuch and is protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or other brand elements.

Content you create within the App (projects, notes, shot lists, etc.) remains yours.

5. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Accuracy of calculations: The App includes calculators, converters, and simulators (such as depth of field calculators, ND filter calculators, aspect ratio converters, and others). While we strive for accuracy, these tools are provided for reference and planning purposes only. Results may vary depending on real-world conditions, equipment, and other factors. We make no guarantee as to the accuracy, completeness, or fitness for a particular purpose of any calculation or result produced by the App. You use the results at your own discretion and risk.

6. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.

7. In-App Purchases

The App offers optional in-app purchases processed through Apple's App Store. All purchases are final and subject to Apple's refund policies. We do not process payments directly and have no access to your payment information. The free tier of the App remains functional without any purchase.

8. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review this page periodically.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Slovak Republic and applicable European Union regulations, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Slovak Republic.
